Terms of Service

Effective November 2, 2026

These terms govern your use of ecomindex.ai and the services of EcomIndex, an assumed business name of Signal Out Labs LLC, an Oregon limited liability company, 5441 S Macadam Ave #6867, Portland, OR 97239 ("EcomIndex", "we", "us"). By buying a report or a monthly plan, you agree to them.

1. What we provide

AI Shelf Report. A one-time report showing how often AI services name your brand when asked buyer questions about your category, compared with competitors.

  • We send about 20 buyer questions to the AI services named in the report, through their APIs with web search turned on, three times each, and analyze the answers.
  • Each report states its method: which services and models we asked, when, and how many answers completed.

AI Shelf Report and Playbook. The AI Shelf Report, plus a 90-day plan of changes built from your store's pages, its catalog and your Google Search Console data. We need read-only access to your Search Console to make it, and we count delivery from the day you give it.

Monthly plan ("Get on the shelf"). Ongoing work to improve how AI services describe and recommend your brand. The scope, price and minimum term are set in your statement of work. That statement controls if it differs from these terms.

2. What the report is, and is not

  • The report shows answers we received from AI services' APIs on specific dates. It is not a record of what every shopper sees in consumer apps such as ChatGPT. Answers change from run to run and over time.
  • Any screenshots of consumer apps in a report are labeled examples, not measurements.
  • We do not guarantee that AI services will mention or recommend your brand, any ranking, share or placement, any third-party coverage, or any traffic or sales.

3. Your responsibilities

  • Give us accurate order details, including the store you want analyzed.
  • For the AI Shelf Report and Playbook: add our email address to your Google Search Console as a restricted user, which lets us read your data and not change it. You can remove that access at any time.
  • For monthly plans: give us the limited store access the statement of work describes, and review the changes we draft. We publish nothing to your store without your approval.
  • Don't use our services to break the law or anyone's rights.

4. How we work on your behalf

  • Outreach we do for you (to editors, reviewers or community moderators) is always disclosed as made on your behalf.
  • We never post as a customer, use fake accounts, manipulate votes, or offer anything in exchange for a positive review.
  • Health and supplement claims follow the applicable FTC and FDA rules.

5. Payment

  • Prices are shown at checkout, plus any applicable tax.
  • Payments are processed by Stripe.
  • Monthly plans: the first month is billed when you sign the statement of work. Each later month is billed in advance on the same day of the month as your start date. Plans renew each month until cancelled under section 6.
  • If your statement of work includes a prepaid minimum term, it sets the amount and the months it covers.

Credits.

  • The amount you paid for an AI Shelf Report counts toward an AI Shelf Report and Playbook for the same store, if you order it within 30 days of the report's delivery.
  • The amount you paid for an AI Shelf Report and Playbook counts toward the first month of a monthly plan for the same store, if you sign a statement of work within 90 days of the Playbook's delivery.
  • Each credit applies once, only toward the next step named above, and can't be exchanged for cash.

6. Cancellation and refunds

  • See our Refund Policy at ecomindex.ai/refunds, which is part of these terms.
  • Monthly plans have a 3-month minimum term, then run month to month. After the minimum term, cancel by emailing hello@ecomindex.ai at least 30 days before the next billing date.
  • AI Shelf Reports, with or without the Playbook, are refunded in full in the cases the Refund Policy lists: a store we can't analyze, a run that fails twice, or a late report.

7. Your report and our methods

  • You may use and share your report inside your business and with your advisors and agencies. Agencies may not resell or redistribute reports to their own clients without our written permission; email hello@ecomindex.ai to ask.
  • AI answer excerpts in the report are third-party outputs, quoted for analysis.
  • Our software, methods and templates remain ours.

8. Disclaimers

Except as stated in these terms, our services are provided "as is". AI services are run by third parties and can change, fail or produce inaccurate answers. We are not responsible for their content.

9. Limitation of liability

  • To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the service in question in the 12 months before the claim.
  • We are not liable for indirect, incidental or consequential losses, such as lost profits.

10. Governing law

These terms are governed by the laws of the State of Oregon, excluding its conflict-of-laws rules. Disputes go to the state courts in Deschutes County, Oregon, or the federal courts for the District of Oregon, and you and we consent to their jurisdiction. Either of us may bring a claim that qualifies in small claims court.

11. Changes

  • We may update these terms by posting a new version with a new effective date.
  • Changes do not affect an order already paid for, or the current term of a monthly plan.
